  • Switch to F1 visa

    Hi
I am currently on Visitor visa.
I need to switch to F1 visa.
My question is I am being sponsered by my Uncle who is a US citizen. He has sufficient financial documents to sponser me.
Is that a problem being sponsered by a person in US & not India?
    Thanks.

      Change of status

      Hello,
Can a visitor visa be converted to F-1 visa without going back to india for stamping? In this case, will the B2 visa still hold good or be cancelled? Also, i am his sister (currently on H1-B) and will be sponsoring him. Is this ok?
      Please advice.

      Thanks in advance!

Am sure you have to go back and get your F1 stamped. Once that is done your B1 will become void when the F1 starts. As far as sponsoring, I dont know about that.

Thank you topcatin for the quick response, i appreciate it!
Can the F1 stamping be done in a different country other than India like Mexico, similar to H1-B stamping? Or does he definitely need to go back to India for that?
Also, since he has to go back or go to a different country anyway to get the stamping, i was thinking about filing a H1-B directly instead of F-1.
Which one is a better option? Please advice.

          Thank you again in advance!

Your welcome. He has to go back to the home country and get it stamped. As far as H1 is concerned that can be filed under the normal quota and masters quota. For masters quota he must have a minimun of master's degree from the US.But if he has a bachelors and some work experience I think you can apply for the H1.But with regards to the H1 you may want to check with a lawyer.Am sure since he is on visitor visa, in either of the cases be it F1 or H1 he will have to go back and get it stamped. I remember reading this somewhere. But I highly recommend talking to a good immigration lawyer about this just to be 100% sure.
