  • Can I transfer from H2B to F1?

    Hi!
    I entered the US on H2B visa 2 years ago and I've been extending it ever since. I know I can do this for up to 3 years. So I'm thinking about change of status to F1 since I have saved money enough to support myself.My extension will expire October 22 2008 and my classes start Aug 18.So I wonder if this will be a problem since I have signed a contract.Will the Immigration Service insist on me fulfilling my contract or can I count on approval of my application for COS? Also, I expect to receive my I-20 around end of April but when should I apply for my F1? I'm afraid if I apply immediately the IS could suspect me as a potential immigrant.Is this right?If yes when is the best time to send my papers? And should I include a motivation letter or anything of that kind?
    If anyone knows anything please help me!

    You can quit your job/contract anytime given! USCIS will not insist on finishing contract, you are free to do whatever you are pleased to do. Just make sure you end your employment in good stand, because some employers do harm H2B people!, Tell them the truth, BUT ONCE you get aproveed! Do the 2 WEEK NOTICE by law to quit your job! That way you can't be out of status!

    Let me know if you were able to get your status change, because I am also on the same boat, I am waiting to go F1 but I never done an extension. Please reply back we can help each other!

      I am from South Africa and on the H2B visa for three years.My visa will expired 31 July 2009.I want to know if i can change my visa status to the F1 visa.What the requirements is.I got a very good relationship with the company i work for.Is there anyone who can help me ,maybe a lawyer who can do it for me ,what my changes are and how money you suppose to have in the bank.Is there also away that i can apply for a work permit after been three years in the USA.I was never out of status always pay my taxes.
