  • Denied F1 VISA after 7 years studing on US

    Hello,

    Please I need help!!

I was studying in US since Jun 2000. I went to College form Sep 2000 until DEC 2004, after I got my OPT for a Year from JAN 2005 until JAN 2006, then from JAN 2006 until Now I'm currently enrolled at school for a BS Degree in computers Science. On Dec 2007 I decided to visit my home country, as normally I went to an interview to get my F1 VISA, after a 30 min Interview the VO told me that my SEVIS number was wrong and I would have to wait until they fix that problem before stamped my visa, after she gave me an 221(g) letter. After waiting almost 45 days I received my passport at the mail with a denial letter (214(b)). My passport was not stamped and My B2 tha I had for the past 10 years still valid until the end of this Year. Now I don't know what to do. I need to sellmy car nad get my associate diploma form my apartment. Can I use the B2 Visa to get ther and take care of this.

    Please help Thanks

    Probably not.

Did you change status from B2 to F1?

It may be a "retaliation" from the consulate for you. Because of your COS from B2 to F1.

        You can try again.

Sorry I forgot some details during those 7 years. I came to my home country in 2001 and I got a student visa on my passport for an year from AUG 2001 until AUG 2002 I came to my home country twice on that visa. Also I got married with my girlfriend on OCT 2005 and I applied for the Green Card on the next year. Then after 8 month together we did the divorce and I ask the INS to withdraw my case.

Applying for a green card shows immigrant intent. F-1 visas do not permit immigrant intent thus the 214 rejection.
