Hi Guys

It was really pleasure to get your reply.I am really informative and updated with the current DHS laws and regulations.Now,If the immigration officer,at the port of entry in US, asks me a question about my reason for

overstay in US for more than my D/S date,then what should be mine best possible answer?

Answer to these question will be really helpful and I will really appreciate your help towards it.

PS:- My D/S in US as undermentioned:
Aug ,25th 2004-May,6th 2006---MSEE
May 31st 2006-May 31st 2007-OPT
June 1st 2007-July 31st 2007--Grace Period( as per I-20)
August 1st 2007- January,27th 2008-- 180 days OVERSTAYED

Hi Praetorian XI

Yes,I am going back to US to do my Second Masters in Technology Management.Since, I was a student so I will opt for Student visa again this time ie F-1 visa.

Unfortunately, I overstayed in US for more than my D/S date which, may gonna affect my student visa while at the Port of Entry.Thus, I am looking for an answer if Immigration officer asks me the reason for living in US beyond my student status.

PS:- I left US within 180 days of my D/S date and I wasn't involve any criminal activities.I also got my US Degree successfully within time with a good GPA.

Are you using a new F1 visa?

Did USCIS notify you that you "overstayed"? because if they did not actually notify you of that, then you have not accrued any illegal presence.

Your I-94 was valid for D/S which is duration of status. I guess you stayed after you were done with school for a few months right? but did you ever get a notification from USCIS or ICE or your school that you were to leave?

It is good to see your reply.Well, No, I am not using any "NEW F-1 VISA".USCIS didn't notified me that I actually overstayed in US.Yes, I stayed 6 months after expiration of my OPT but, I never got any notification from USCIS or ICE or from my school that I have to leave US immideatly.

However my D/S in US as undermentioned:
