so, my story is - I came here in USA on a student exchange program. My J1 visa was about to expire on 01 OCT 2007. In my 30 days gratis period i applied for a tourist visa. My intention was for studying here.
My lawyer told me that changing from a tourist to a student visa will be easer than changing from j1 to student. Any way i payed him and i send him all the information for making the process through the tourist one, and still until today 23 march 2008, in the uscis website my process is still pending
Application Type: I539, APPLICATION TO EXTEND OR CHANGE NONIMMIGRANT STATUS
Current Status: Case received and pending.
On October 30, 2007, we received this I539 APPLICATION TO EXTEND OR CHANGE NONIMMIGRANT STATUS
But in the same time i sign in a college when i was still with my J1, and I received this form I-20 M-N.
My classes started on 01 NOV 2007.
The thing is that i dont have the stamp in my passport..... i dont have my tourist visa neither..... and my i -94(from my J1) already expired.
I read almost all the posts in the forum regarding student visa issues ... i am sorry if i am repeating them....
There is no way for stamping my passport in the USA ?
Am I in trouble right now? I mean, i am violating the law?
Is the I-20 form proving that i can stay here legal?
The thing is that, I need to go out from the country to visit my grandfather from Colombia (i am from Bulgaria)... is this possible ? i need to go there only for 1 weekend and then to go back in the USA...
Can i stamp my passport there ? Is it going to be sure that i will get the stamp so i can continue my college?
