  • Need some clarifications about my visa.....Appreciate all help....

    Hello guys,
I was informed by my school that I was out of status for dropping out of a course in between the semester after i filed the required reasons and all the letters from my department and everything, but the DOS at my school did not accept it and she said that I'm out of status. So accordingly, I applied for reinstatement and i also continued in school and I finished my degree in December 2007. I had to apply the reinstatement through my school and they did not file it on time leading to which time I already graduated, so the options which they gave me was to apply for a new Masters and go ahead and get a new SEVIS ID as my old one was terminated long back. So the basic question which I do wanna ask is whether I need to apply for a new visa again to continue my studies in the new university or would my old one which is valid till 2010 be enough for me to get a re-entry into the US.

This is the reply I got from the consulate:

"Please be informed that Returning students may re-enter the U.S. on their valid F-1 visa as long as they have a valid I-20 with a SEVIS number even if the SEVIS number does not match the number on their visa. But any absence from school over 5 months, UNLESS you are in a study abroad program, would require a new F1 visa."

Just wanting to see if there is any other person with a similar experience. I'm ready to apply for a new visa again if the need be. Please do clarify as soon as possible. Looking forward to your replies.

    Regards,
    David.

My understanding was a new visa had to be applied if the SEVIS id changes which is contradicting what the consulate said. So, not sure.

      hmm.....

what would your reaction be if I said I was out of status for over a year and now have a new i-20 and a new sevis id? I think I might also have to apply for a new visa after all. Anybody have similar experience???

You have to apply for a new visa anytime out of status issues are there as per my understanding. Especially for F1, your status is dynamically updated on SEVIS. You get a new SEVIS id only under such circumstances and I would say it is better to apply for a new visa.
