  • to get F-1 in my country after denied Change Nonimmigrant Status

hello! I have received that denie message from USCIS:
Upon consideration,it is ordered that your Application to Extend/Change Nonimmigrant Status(Form 1-539) be denied for the following reasons:
On March 12,2008,you submitted a Form 1-539 application to change your nonimmigrant status to F-1.The SEVIS Certificate of Eligibility submitted on your behalf listed your program start date August 25,2008. You must maintain your current nonimmigrant status up to 30 days prior the start classes in order to change status. A search of service databases does not reveal any other application or petition filed by you,or on your behalf, that would extend your authorized stay to within 30 days of your anticipated start date of classes. As of the date of adjudication of this application your status has expired, and there will be a gap in your authorized stay.
You may not remain in US without valid status, therefore, your request to change your status is denied.
    -------
I am going to my country soon, and I would like to apply for F-1 there.
Will i have more problem with getting F-1 visa because I tried to change status from B-1 to F-1?
    Thank you!

B1 to F1 COS is frowned upon by VOs and USCIS. Also, you accumulate unauthorized presence from the date of the I-94 expiry and have voided your B1 visa as a result of the denial. Mention everything truthfully and show your ties to home country. Approval of F1 will depend on how you can convince the VO of your ties to home country.

    Good Luck!

Your B1 is automatically void if you overstayed your visit. You have to apply for a new B1 visa if you plan on visiting again or you will be risking an expedited removal if the POE officer finds out about your previous overstay.
