  • Using CPT to work and then applying for H1

I completed my Master's degree last year and I did not get selected for the
H1 lottery this year. My OPT expires in Jan 2009.

One of the options I am looking at is to enroll in another master's program starting in Jan 2009 and use CPT to continue working for my current employer. And then the employer plans to apply for H1 again next year.

If I get selected in the lottery next year and I drop out of the degree program to change to H1, will I have problems with my H1 getting approved since I would not finish the degree which was the reason for staying on F1?

This looks like a good option but I want to look at all the possible problems that could arise. Any information would be appreciated.

    Thanks.

Except that USCIS can consider that your intent was fraudulent just to utilize the CPT. CPT should be part of the program intended but not just to work.
