    Hey guys,

    My wife and I just got married...she was in the country(USA) for school...and now we are married. I will be leaving for 6 months and she has decided to take a small break from school during this time. we have not applied for a greencard yet and we were wondering if "advance parole" would be necessary? Or would a valid I-20 be enough for her to come back and continue school w/o incident?

      I am sorry I didn't write that she is going to Taiwan. We are not applying Green Card for her because after she is done for school we will move to Taiwan. So when she comes back from Taiwan this time with I-20, does she need Advance parole as well? The Immigrantion office told us is she doesn't want to be US citizen, she came come back from oversea with I-20 only. Is it correct?

            As a student one has to attend classes and be a full time student. If she stops going to school that I-20 is invalid. Also i read somewhere that if a student gets married F1 status is lost...what i would suggest to you is to speak to an immigration lawyer. If your wife leaves and she wants to get back here it will be difficult and this will maybe take you long to bring her back where by you will have to come back and petition for her to get back here on a K3 Visa.

              I20 issue

              I know that if you are an F1 student, you are required to attend school full time while you are in The U.S. But if you want to go home(out off the country), you just need to tell your adviser at International Office(DOS). She/he will sign on the third page of your I-20 (valid for 1 year), this will let you come back to U.S. Also, don't forget this. if your visa for F1 is still valid on the day you return to the US, then it is no need for you to obtain another F-1 visa (K-3 is not applicable to you anymore because you are already married). Otherwise, you have to get a new one.
              And about you marriage situation. As long as you did not apply to adjust your status. You are still F-1 student. You are married but you do not have intention to live in the U.S., so you absolutely do not violate to the F-1 law.

              P.S. You did not indicate that when your I20 expires. This is very important to. the day that you return to the U.S., your I20 must be valid.
