  • COMPLICATED SITUATION Please Help !

    Hello there !

    This is my story :

    In october 2003 i entered USA (Los Angeles port of entry by air ) as a F1 student visa .
    The F1 student visa was for 2 months.
    Before the visa expired i applied twice to INS for an extension but unfortunately they lost my file (twice—can u believe what a bad luck i had )
    After that i have decided to stay illegal , and work illegal in Los Angeles until december 2007 (4 years )
    In december 2007 i decided to leave USA for good and return to my home country (somewhere in Europe)
    After spending some time (4 months ) in my country i decided to apply again for a visa(business) in order to return to USA.
    So , i applied and got rejected.
    I was very angry , and i said to myself that i WILL do anything in my power to get to USA .
    So , i TRAVELLED to Mexico , to go to US border with Mexico (TIJUANA ).
    At the US border (San Ysidro check point ) i tried to get to USA by bus .
    At the border , US immigration asked me about my passport and i said that i’m a US CITIZEN and a dont have the passport with me , i have my CALIFORNIA ID instead (real is not **** because as i said i used to live in Los Angeles for 4 years ).
    They didn’t believe that i am a US CITIZEN and checked and detained me because i LIED about my citizenship, and tried to get to USA illegaly.
    I wanna tell u that i LIED about the fact that i’m a US citizen because i heard from many people that in the past years if you were in Mexico as a tourist and try to cross the border in USA u could do it using your ID only and by saying that you are a US CITIZEN (VERBALLY )
    So i got detained for 5 weeks and then got DEPORTED to my home country .
    US gov paid for my plane ticket .
    I did not see the judge just straight deportation .
    I was told that i’m banned for 5 years to comeback to USA.

    I’ve got questions for u :
    1.What REAL chances do i have to comeback to USA after the 5 year ban ?
    2.If i apply for a waiver for deportation , do i have a real chance or not?
    3.lets say i will marry a us citizen abroad ( who can come to my country in order to get married for real ) do i have any chance to get to usa AFTER the 5 year ban or i will be delayed or denied ?
    4. i was told that no matter u do , if u try to get us papers for real or not because i tried to get to usa illegaly , i have a black file with us immigration and i will get denied everytime i will apply for something regarding papers. Is that true ?
    5.Because i had my visa overstayed by 4 years , i was told that i will get a 10 year ban .
    Is it possible that US immigration to ban me for 10 years (5 from deportation and 10 for overstaying ) even though they said that i’m banned for 5 years for illegal entry.(lying )

    Claiming to be a US citizen in order to enter the country when you are not is one of the worst things that you can do. It is unlikely that you would ever be permitted to re-enter the country.

    You really messed up BIG time guy! You can try talking to an attorney but don't hold out much hope for a future in the US.
