  • F-1 Marrying to a GC

    I am U.S. Green Card holder and will eligible to apply for citizenship in end of 2009. I fell in love with an international student who holds an F-1 visa. She is in status and attending college. She has been here for the past year. Now I want to get married to her and apply for her status change once I receive my citizenship. Will this cause any problem when I petition for change of status. Also, can she travel in and out with her valid F-1 visa and have any issue re-entering the country since she is married to a GC holder. Please help me.

    She should not leave the country once she has married you. She has to prove non-immigrant intent and she HAS IMMIGRANT intent. So, no, she should NOT leave once she marries you.
