My brother came on f1 visa in 1998 for doing MS (with thesis). he got his visa extended once for one year in 2001. He cpmpleted his course work but has not defended his thesis yet. He was planning to do PhD in the same university .
His visa expired again and this time he came to India to attend a marriage. He got his MS I-20, PhD I-20 and also a financial support from me (Perm resident of US)
He applied for visa in Chennai and it was rejected the reason stated was "prospective immigrant" sec 214-B
He is planning to apply again by post just for MS extension(no PhD).
has anyone come across this kind of situation ? any suggestions ??
