Instate vs Out of state fees

Hello,
My daughter has Work Authorization Document, she is during the process of Green Card. She has been resident of New York from 2004.
She is a student of Hunter College in New York. They do not accepted her as a instate student, they explain her that WAD is not document which qualify her to benefits for instate student, they put her in status of international student.
Do she has right to apply for instate status with WAD card?

What is her legal status? In other words, on what basis she got the Work Permit?

I was sponsored for Green Card from my work place, she is fallowing up as my daughter.

Does she have greencard yet? Or just the EAD?
