can I apply for H1 and F1 both

Hi,

I applied for my F1 in November first week. My case got transferred from Vermont to California in January last week and so I am still waiting for my F1.

Now with my F1 application already with USCIS, can I apply for H1 on April 1,2009. Will both my applications be considered valid? Or if my H1 application is filed on April 1,2009; my F1 application will get canceled?

If my H1 doesn't get picked up in lottery then will I have to apply for F1 again?

Please let me know urgently.

If your H4 I-94 is unexpired, you will be fine. If not, you will be in trouble if the H1b was filed as a COS as the bridging F1 petition has to be approved for a COS.

In all cases, last action rule applies. Last petition to get approved determines your final status.
