My brother in law is studying @ a flying school in Southern California. He is here on a M1 visa. His visa stamp and I-94 had an expiry date of May 31st 2009. His final exam to get the certificate was on May 23rd 2009 but it was postponed to 30th May 2009 and then to 8th June due to unavailability of the examiner as well as bad weather in Long Beach last week.
As this all was unexpected and happened last minute, there was no extension filed for his stay here resulting in him being out of status.
He has his final exams on June 8th, , 2009.
Here are my questions:
a. Will this affect him coming back to the country if he is issued a visa next time?
b. What can he do now to reduce any complexities with the case?
c. Should the school provide him a letter that might help him?
He plans to give the exam on Monday and fly out on Mon. nite / Tuesday morning back to India.
