  • f1 visa in chennai embassy

    I am in india. I applied for H1 for october-2009, and the petition is with USCIS.
    Now i got admission from a school from US and i want to go for F1 student visa stamping.
    Would my H1 petition show up when i go for the F1 student visa interview?
    Will that H1 be a problem for getting my F1 visa?
    Please let me know.

    They will have all your records. But, don't worry. Be prepared to answer the questions -
    Do you want to study or work?
    What will you do if H1 gets approved while you are in school?
    What will you do after you complete your study?

      Thanks a lot for the response. If H1 gets approved while in F1, how will i continue to stay in F1? Can i withdraw/revoke/cancel the H1? Will my F1 SEVIS be automatically cancelled once H1 is approved? How do i avoid that? I want to continue to stay on F1 till i finish the school.

        Were you in the US when H1 was filed, if so was it filed as a change of status case?

        If not, change of status will not be automatic. You will have to apply for it to work on H1 or remain on F1.

          H1 was applied when i was in india. am still in india. am going for f1 stamping. during the f1 stamping i am afraid that if they know my h1 has been filed (h1 is not approved yet, its in RFE status), then my f1 visa stamping will be difficult? any help?

            Since your H1 is not COS case, you will be on F1 (if visa is approved and you use that to enter). In order to work on H1, you will have to either apply for change of status from within the US or leave, get H1 visa and re-enter.
            If you entered on F1, you will need to do nothing to continue studying.

              Thanks a lot, appreciate your great help. Its clear to me now.
              That leaves me with only one concern, during the F1 visa interview, if they find out that i applied for H1, will my F1 visa be in danger? I believe i have to prepare a correct answer for that. I dont "really really" want H1, i just want F1 and i hope i can convince them.
