  • H1 to F1 after layoff ... URGENT

Currently on H1-B but will be laid off on June 11 (few days from today)

    1. What is process for conversion of H1-B to F1 ?
    2. Once I have an I-20 and apply for COS, do I have to wait for an approval document from INS ?
    3. If I apply for COS before June 11, am I still considered "out of status" from June 11 to when I get F1 approved. What are my options?

    Thanks!

    hi,
I lost my job end of April and almost within a week I submitted my papers for changing my status from h1b to f1. I recived a letter from immigration office asking to prove 3 things.
    last 3 pay checks
    grad degree (from my country)
    an explanation why changing status

first question from my school adviser when I called him to let him know what happened was if the color of the letter(notification) is blue...NO, it is not, he found it to be concerning...now I am concerned, why are they asking for my undergrad diploma given the fact that I did my masters in US and worked for an emplyer on H1B. is this a normal process?

Is this concerning, can anyone please help me with this?
    thank you

      1. Get admission to university, get I-20 from them. then apply using I539.
      2. Yes, you have to wait.
      3. No, if the application is received by USCIS within a few days of layoff you are ok.
This is my opinion and not legal advice.
