  • F1 rejected under 214(b) for Second Masters

    Hi All,

    I had been on F1 visa from Aug 2006 and I studied for a Masters degree in an Interdisciplinary Engineering course in a top-ranked US university for a year and half. After graduation in December 2007, I started working on F1 OPT from Feb 2008 for a company and obtained my H1 visa which started in Oct 2008.
    Unfortunately, I was laid off in May 2009 which meant that my H1 visa was terminated and whether my company reported it or not, for any visa that I applied for next, there would have been a gap in my visa status and I was on void status.
    I then decided to go back to school for a 2nd Masters in Engineering Management and I was admitted as well.
    However, since my H1 visa was terminated, I had to come back to my home country and apply for a fresh F1 visa. The visa officer asked me why did I needed to do a 2nd Masters and wasnt convinced on whatever explaination I gave.
    Also, my sister is a US citizen but she has returned back to my home country and is now working here for 2 years.
    The visa officer denied my visa under section 214 (b) which I believe is that he thought I was a potential immigrant.

    I was wondering if I should reapply again in a month's time or not and needed advice regarding the same. If my visa gets rejected for a 2nd time, it might be a problem cuz getting accepted for a third time is nearly impossible and I might not get ANY visa for another 2-3 years because of 2 rejections.

    Please advice or share your experiences if you have had similar ones.

    You definitely suit the typical potential immigrant stereotype as you have been trying to be in the US on some status or the other. Usually, a second MS is not looked upon by VOs as something good. If it was a MBA or a higher level of study, things could have been different.

      How would you suggest I convince the VO that I do not have ny intention of immigration and that I want to go to the US only for study purposes alone ?

      Do you think I should reapply again then?
      Or apply for a different degree then?

      Please give me some pointers or other suggestions that may help me,....

        The usual stuff. Property ties, familial ties, good reason as to why you want to pursue the second MS? What the prospects for that study are in the home country etc.

          Hi, i would like to know if you managed it

          I met with a similar case but i did my masters in sweden. my visa is rejected after a question about my activity after passing out from under grad.

          My intention was clearly to do a specialisation in a different field but i want to know if i can retry or move with my research opportunities in other countries..
