Can anybody clarify on this? I came across this interesting situation:
Change of status from H1B to F1 Visa while H1B transfer is pending?
I got laid -off recently from a full time job and my H1B Visa will be terminated. I have applied for a H1B transfer with a different company. got RFE on client location and my current employer replied RFE. When I checked the status of my case online, it shows my case is pending. Now I want to know
1) I have applied for Masters in Computer Science with a university and they have offered me admission for Fall 09 which starts within next week. Can I apply for a CHANGE OF STATUS (COS) to F1 which my H1B transfer is still pending with USCIS?
2) Can I join the classes immediately after applying for the COS or do I need to wait till the I-539 got approved?
