Need Help! F1 Travel

I entered on a B1/B2 Visa and have since changed my status to F1 and attended college for 2 years, however my I-20 is valid until Dec 09 and my passport has expired so I need to travel to my home country and renew it.

I have an approved I-130 Petition filed by my mother and am waiting on the priority dates to come up (2/3yrs) but I have to mantain legal status meanwhile. What are my chances of getting an F1 Visa at the consulate? Will they check if there are any petitions or is it something I have to tell them?

First, you cannot travel anywhere on an expired passport. You need to find a means to renew it here.

Second, You have an immigrant petition and you do not qualify for entry on F1 or B1/B2 in the future.

Consult an attorney or you will land up in some serious consequences or do your own research.
