My cousin with an F1 visa got married to a green card holder outside the US (in their home country). They left together almost a week after marriage however never changed the marital status of my cousin (still single). Due to certain problems the two have separated and my cousin came back to his hometown almost a year ago. Now he wishes to resume his studies for which he has to apply for a new visa.
The problem is that they have not yet applied for a divorce but have been living separately for more than a year. If he has to produce evidence of marriage there is no certificate though proof as in photos etc are there (the marriage is recognized as per customs of their country but was neither registered there nor in the US). The problem is that he fears what to do with his marital status (single/married/separated) for a new visa as, he had never changed his marital status in the US and fears this may account for rejection.
Can someone provide with any suggestions?
    Thanks
