  • F1 OPT stamping, spouse on O1

    Hi,
I am currently on F1 OPT and intend to travel to India to visit my family. I need to get my F1 stamping done. My spouse is on O1, and has not filed for permanent immigration.

    1. Is there be a potential concern when I go for my stamping to the consulate given that my spouse is on O1? This is mainly regarding demonstrating home ties in case of F1.

I used to be on O3 but I changes to F1 to study and gather work experience on OPT. I attended a reputed school.

    2. Is this change a potential concern too?

I will have around 4 months left on my OPT at the time of the interview.

    3. Do I need to have at least "X" number of months left on my OPT to be able to get the stamping done without any issues?

    Any help is greatly appreciated.

    Thanks

    Hello,

I am in a similar situation. I am planning to travel to my home country in early November and my F1-visa stamp is expired. I got my STEM OPT extension approved until July 2021. My husband is on an H1-B visa with an approved I-140 via EB2 category. Is it travel abroad recommended to renew my F1 visa at the consulate with my spouse being an H1B visa holder and having an approved I-140? His I-140 was approved before our marriage. Is their risk involved as my immigrant intent can be questioned for F1 visa renewal? Would it be better to get H4-EAD instead?

Please share your experience if you were able to successfully get your F1 visa stamp renewed, or if you have advice to share.

    Thank you.
