I need help. One of the very common questions. My USA journey so far.
F1: Entered on F1 visa (Masters in Computer Science) in April 2015
CPT: 6 Months (last semester)
OPT: October 2016 to September 2017
STEM OPT: Denied as my school had some issue with ACICS accreditation (which was later went into favor of all schools in 2018).
Enrolled in PhD: January 2018 at University of the Cumberlands
CPT: Day 1 CPT from January 2018
H1b: Applied under Premium in April 2019
H1b RFE: Responded by 08/18/2019
H1b Result: Petition was approved but COS is denied.
Reason for COS Denial: Obvious reason is "Did not Maintain F1 status".
Also, I am working as a contractor (Employee --> Vendor --> End Client).
My questions are:
1. Is there any way I can sustain my stay in US without going for H1b stamping?
2. If yes, what are those ways?
3. If not, what documents should I carry to defend the interview?
4. I am expecting 221G process? In that case, will I be able to come back on F1 again?
5. Am I going to be out of status from October 1st, 2019?
6. Is Reinstatement an option in that case should I decide not to go for H1b stamping?
7. If we revoke the H1b, will it restore my F1 status back as active?
