My wife is on F2 VISA in US and we hope she'll get sponsored for H1B soon. I was speaking to an immigration attorney who told me that going from F2 to H1B might be construed as VISA fraud as "you'd come to US under the pretext of temporary work". He said this has become more of an issue under Trump administration.
1. I wanted to ask if anyone here has faced or heard of this issue. Honestly this is a bit of a shock to us. And come to think of it, it does sound definitely a bit ridiculous. I mean if some firm is willing to sponsor an individual, why should that be a problem...
2. Alternate option I have is to switch from F1 to J1. Are there issues going from J2 to H1B (except for the home residency conditions etc)? Please share experiences if any.
