  • Have an unexpired F1 visa but got rejected for a new one

    Hi!

I have just completed my bachelors and got admission to masters in the same university in USA. My current visa expires soon so I have decided to go outside US to a 3rd country where I grew up to renew or get a new visa. But I got rejected saying that I dont have strong ties to my home country. I had all the documents of my parents establishments and property with me but the counsellor didnt want to see it. My question is can I still return to US with the current visa (before it expires) or am I not able to go back? Will appreciate any kind of help. I am really stressed.

The thing is my visa expires on Aug 15,2010 and I am planning to return on Aug 10,2010. I have a new I-20, for masters which runs until Aug 2013. I am just curious if I will be stopped and deported back from the airport because I got rejected for a new visa? I couldnt believe why this happend to me as I didnt apply for OPT and applied straight to masters and also been offered a graduate assistantship position. My only negative side was that my sibling is a US citizen who has been living in the US from last 16 years. The officer kept asking about my sibling and never asked me what my plan is after graduation. I am so stressed. Feels like the world has ended for me.

    Hello,

Technically, you could return as long as the visa is still valid, but it is at the discrection of the immigration officer at the port of entry to let you in the U.S. or not. So, you could be turned away. It is not a good idea to come and then allow your visa to expire because that will cause you problems. You may want to contact a good immigration attorney to help you. Best of luck.

      Try again at the Embassy

It is generally up to the discretion of the immigration officer at the port of entry, but it will be very difficult to explain a 5 day stay in the United States.

One thing you could try that a lot of people have tried successfully is to go to the Embassy / Consulate and try again. Depending on the person at the counter and their mood you may have another chance. However given that your situation is precarious and you don’t have much new material to present, I would consult an Immigration expert in the country that you are in.

      Good Luck and God Bless.

        you can try..

visa is only for entrance to US, if you have new i-20 you should be fine.

and if you come you need to register for classes and keep yrou status.

Go ahead and try to enter before the visa expires. As the previous poster said, visa is just for entry. You can enter the U.S. today if your visa expires tomorrow as long as your an I-20 (stamped by the internation office for travel) and you intend to enroll full time.
