  • Unintentional F1 OPT Overstay

My F1 visa expired in Jun 08 and my opt started July 08 and i left the USA in Feb 09. i was unemployed during this entire time and i was unaware that i couldn't stay till the end of my opt expiry date on the EAD card.

How do i find out if the USCIS knew that I was out of status and therefore an overstay? i wanted to know if i have incurred any illegal overstay and whether this will have any impact on my future non-immigrant visa B1/B2 applications. What sort of questions will this subject me to in the future at the non-immigrant visa interview?

The burden of tracking your employment status is with your school's DSO. Now that you have left the US you should be fine. Technically it is not overstay but it is only out of status period.
This is my opinion and not legal advice.
