  • Applying H1-B while being on a student visa and 6 months away from graduation

    Hi,

Right now I am on my F1 visa. I will be graduating in december. I have been doing an internship with one company since last 4 months. They want to hire my as a full time employee and apply for H1B visa as soon as possible. Right now I am on my CPT and will be starting pre-OPT from coming September 2010. I have completed all my course work just half part of the final year project is remaining. But it is a no credit course.
Can my employer apply for my H1-B visa immediately? Even though I will be graduating in December? What are the chances of it getting approved?

If it is a Masters that you are getting, the company may choose to apply based on your BS.

If you are getting your BS, they cant file.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
