OPT query

Hello all,

I have graduated and am currently on my OPT. I am currently working on a project for a company that is paying me using form 1090 instead of W2. I was just told that this does not count towards employment and would add to my unemployment time on the OPT. Is that true? If yes, can I ask the company to pay me on a W2 without having a H1B filed in my name?

You can work as an independent contractor while on OPT. You must report this period of employment to your school's DSO. Search the ICE and USCIS websites for OPT/F1 guidelines. This is clearly mentioned in one of the guidelines.
