  • US Visa DS-160 Previous US travel - Answer for US visa refusal

    I am filling DS 160 form for Spousal visa (F2) and it asks whether I have previous US visa refusal cases as follows:
    "Have you ever been refused a U.S. Visa, or been refused admission to the United States, or withdrawn your application for admission at the port of entry? "
    However, I had applied L1 Individual Visa 1 year ago with 129 petition form through my employer and USCIS unfortunately refused my application.

    Can anyone please let me know what I should mention to above DS 160 question ? - Is it as US Visa refusal and YES or No ?

    Moreover, there is also another subsequent question as follows:
    "Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?"
    For this question, should I mention YES ? If so, is it enough to mention that USCIS refused my L1 petition only? Or how I should explain it ?

    Hi,
    Per my knowledge, It is asking only Visa which means, Visa can get only from US consulate/Embassy.. So, If you have any visa rejections at US Embassy/consulate then you can mention as Yes..
    Immigrant petition means GC. If you ever filed I-140 or I-485 then you can provide those information, If not please answer as NO. For your Information, L petition is Non immigrant petition.
