    Help! f1 student
    Here are the facts:
    I´m a 26yr old portuguese citizen and I went to the us (san diego) in Jan 2006 to learn English as an f1 student. In sep06 I transfered to a community college.
    After 3 years i finished my program at san diego city college and was going to transfer in sep09 to san Diego state university as previously admitted by the institution. Right before fall 09 the university sent me a letter stating my application had been refused due to having less than sixty transferable units. I had 58. At the moment I had an incomplete class grade from the community college which was going to come in dec. 09, as it did. So from september09 thru DEC I was out of status thinking to get reinstated once that class grade came. So then in january o went to the university to get reinstated when they told me the applications were now closed and i could only apply for fall2011. I realized being out of status i had to leave the country. In january I had serious medical issues and had to some exams thru march. I also had lost my passport and the consulate was able to issue me a travel document and I left on may 1st 2010.
    The problem is my f1 visa got denied now in August2010 and I can't finish my studies!
    The CO denied me under 214(b) two times - aug. 10th and aug 17th. I had a new I-20 for a college in Texas where I have a relative to stay with . Before transfering to a four year university I decided to go to college as I could take some more classes and speed up my graduation.
    Im missing one or two classes to have an associates degree. i focused on getting classes for transfering and not all the gen. education requirements for an associate´s degree .It really sucks I'm not able to go back to finish it.
    1st interview: denied under 214(b).. the CO actually didn´t even ask me about ties to my country. he just focused on my previous overstay and said "Why did you stay?" "You should have come back." and i said yes i stayed because i was waiting on the incomplete class to get reinstated. Then i had the health issues and was waiting to get my travel permit.(have proof of everything).
    After getting denied 1st time, i called the embassy about my second interview to come and how could i overcome the persumption of intended immigrant. The converstaion was pretty long and i ended up saying that the CO that denied my visa was a bit rude and arrogant.
    At The second interview my hope was high as i had much supporting documentation for my return and documents relating to my previous overstay. At this time was the other CO. One of the first thing she said was that they heard my converstaion on the phone and that i said that they were rude. I could totally tell she was not happy with it. Rude is probably not the right adjective but CO´s can have this attitude of supremacy that puts you in an unconfortable situation. Right?
    she said "you think we don´t hear the conversations?" yes we do. and FYI we treat everybody with manners and respect.
    She pretty much knew all the information/documents i was going to take as i had said it on the phone with the embassy. and said "I don´t wanna look at any documents. she just looked at my transcripts. "I can´t give you a visa, you´re a mediocre student and you wanna immigrate to the us and the best way is to go as a student. It is not true! I really just wanna go finish my studies!
    My gpa is 2.3. I know its not excellent but A 2.3 gpa is a good academic stand and I'm able to transfer to a university with it. I know its not the best but It won´t influence my degree. I was also going to improve it by going to a community college now in September.
    I also mentioned that my overstay was influenced by , primarly be waiting for the incomplete class, but i also had three cars which I sold from Oct 09 thru feb 09 and was dealing with my lawyer for a legal injury claim. She then said: oh yeah so who was giving you money for the cars? (Like, you were making money there huh..) They were cheap 1960´s rusty classic cars.
    I really wanna go finish my studies at an american institution. I have All the evidence for my intended return, guaranteed job in my field when I come back (legitimate written job offer in construction engineering), united family with 13 year old brother, bank account,and my parents own 3 properties including one in an island.
    Please give some advice about my situation and how could i go finish my studies!
    To make it worse, most of the classes I took were general education which I can´t transfer to a portuguese university.
    I'm really depressed as all these years count for nothing and my parents spent a lot of money in my education which is really nothing! But most importantly my future!
    what are my options? will an attorney help?
    Any advise is appreciated!.
