  • OPT RFE Attendance records are not provided by college because of FERPA

    Hi everyone, I need your help in responding to the RFE I received from USCIS for my OPT request. Please suggest.

    I have everything from DSO, except what is asked in #4.
    According to DSO, attendance records are not provided by college because of FERPA and they directed me to include any information (including transportation receipts, lodging, etc.) to prove my physical attendance on the campus.

    I have attended the in-person classes, but I do not have the transportation receipts because I lived with my spouse in nearby city (11 miles distance from college). I am not sure what to provide as lodging proof and if bills with my name would be helpful. Also, as the city where I lived is different from that of college, not sure if USCIS would consider it. Also, last four semesters were during COVID, because of which the classes which require physical attendance for F1, were held online.

    RFE ----Evidence must include but is not limited to----
    1. Statement from the Designated School Official (DSO) and the Registrar attesting to your physical presence in the classroom.
    2. A full description of your course of study/academic program, including all graduation requirements such as the number of credits or classroom hours and your college's definition of "full course of study" for your degree level;
    3. Copies of your course syllabi for all classes and coursework in which you earned credit towards your degree. Provide delivery method (in person/lecture, lab, virtual, online, tele-learning, broadcast, satellite, etc.) of the course if not listed on the syllabus;
    4. Please submit attendance records for all classes you physically attended while enrolled at XYZ University;
    5. Proof of tuition payment made by you for the duration of your enrollment.
    6. A copy of your most recent transcripts showing number of credits or hours received.

    Hi,
    If you don't have attendance certificate then you can consider below mentioned proof as secondary evidence.
    1. Parking pass
    2. Library books bill
    3. Credit card bill that you might have used on that day near to college.
    4. Any Email conversations you may have with your professor during classes.
    5. Hotel or motel bills that you used during your scheduled class days.

    If residency days were cancelled due to COVID-19, please provide documentation from the school showing classes were cancelled for each semester in which classes were cancelled. May be you can share Email that you might have received from college. And meeting request for attending online classes etc..
    Thanks

      Thank you for your response rkk09 . I do not have any of the mentioned proof you suggested, because I travelled in car with my spouse to college. Also, I have not taken any book from library during class visits. Professors did not send any one to one email during the class.
      During COVID, classes were not cancelled, but were held online. College has sent emails for classes being held online due to COVID,

      Can bills/ mails showing my name and address would be helpful? Along with justfication in cover letter, saying I stayed (11 miles from college, in a different city), hence I do not have transportation receipts or parking passes? I also have driver's license showing the address.

        Hi,

        Can bills/ mails showing my name and address would be helpful? Yes. Of course.
        Please try to gather as much as documents to confirm you attended classes. Any kind of documents.
        Thanks
