F1 STEM OPT > H4-EAD
My wife is currently on F1 STEM OPT (EAD) which ends in June 2022. My current H1B is valid till Jan 2024 and I have I -140 petition approved. My question is if I apply H4 and H4 EAD for my wife, how would it effect her STEM OPT and her job. In case her H4 is approved but H4 EAD is still pending, would her STEM EAD be still valid and she can continue her job till Jun 2022 ? Please clarify these points so I can take necessary action. Hi,
If you file change of status and it got approved then your previous status will not be in place any way. So, If you get H4 change of status approval then immediately you will need to stop working until you get H4 EAD Approval. Please note, your STEM OPT will not be valid the moment you get H4 status.
In order to utilize STEM OPT, you will need to again file F1 change of status petition.
