My wife is planning to graduate this semester (spring 2023). Her school has approved the I-20 request with OPT recommendation. I wanted to confirm her eligibility requirement of being a full-time student for one academic year for applying for OPT. Her OPT-recommended I-20 has a start of June 27, 2022, and an end date of May 06, 2023. Although the I-20 has a start date of June 27, 2022, she has been a full-time student since 01/03/2022, she did her first semester (spring) on H4.
Does she meet one academic requirement based on the dates on the OPT recommend I-20? There is conflicting information on the web regarding one academic year. The most valid source I found was on SEVP Policy Guidance and ****** Law firm page which explains one academic year to be 30 weeks of time for programs offered in credit hours. I am not sure why her school keeps referring to one academic year as 365 days. Also unsure if the USCIS personnel are aware of the fact that one academic year is not one full year.
If she doesn't meet the one academic year requirement solely on OPT recommended I-20 dates, Can I attach her unofficial transcripts from spring 2022 as proof when doing her OPT application online?
