  • Effect of F1 visa on existing L1/L2 Visa and their status

    Hi,

I am working in US for last few months on L1-B visa. My wife is also in US and will be getting her work authorization in few weeks. I was recently admitted to an MBA school.

    1. Is it possible to start my MBA education without returning to my home country to get my F1 visa?

    2. Is there any way my wife can keep working on L2 visa while I am studying in US on F1?

    Thanks for all your help.

It is not clear if you want to pursue MBA full time and continue to work on L1 or you want to quit L1 and move to F1 status from your post.

If you are moving to F1 status, L2 status is void and you have to file for a COS for the dependent to F2 status and no work is allowed from L2 EAD.

EAD is valid only as long as you hold L1 status.

You can change to F1 status inside US by filing for a COS which does not need you to travel and get a visa. You have to apply for both or your wife will become illegal.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
