Converting from H4 to F1 - filling I-539

Hi Friends,

I am converting from H4 to F1 for studies. I am in middle of filling I-539 and I am struck at 2 questions

3a) Are you or any other person included in the application an applicant for an immigrant Visa

3b) Has an immigrant petition ever been filed for you or for any other person included in this application?

My husband got his I-140 recently...so do we have to answer this as YES...? Please advise. Thank you..
