F2 visa for my wife was rejected in Chennai yesterday. I am currently on OPT.
The visa officer did not seem interested in asking a lot of questions, and rejected the visa straight away once she realized that I have finished my masters and I am on OPT. I think this is a classic case and after researching looks like a lot of folks have faced the same situation especially since OPT is a short term one year permit.
I will be applying for a H1 and H4 soon, but since that would be valid only from October, I was hoping my wife could join me on F2 in June. My legal council is suggesting that I re-apply on F2, but this time make it clear that I will be applying for H1 and H4 the following month. They would be sending me a letter stating the same.
Do you think with this additional information, there are chances that the F2 might be approved, since it is really not in interest of the embassy to reject the visa cause I would be applying for a H4 anyway?
Any help would be appreciated.
