    I posted this in the TN forum, but I figured it might be better answered here...

    Hey guys, I was looking for some insight on my problem.

    We are a Canadian family. My dad got a job in the US on a TN visa. He moved here in December 2002, and my mom and I followed in July 2003. I finished middle school and high school here, then started college. I am about to enter my senior year of college in Fall 2011, set to graduate May 2012. I have been paying in state tuition, as I am going to a school not far from my parents home/where I've been living for the past 8 years.

    My dad recently lost his job, and hasn't been able to find work. My parents are basically being forced to move back to Canada at the end of July, with nothing. Since the TN expires at the end of his pay check, my status here will also expire. My status was set to expire when I turned 21 (November 2011) anyway, as I wouldn't be a minor anymore.

    I am looking to switch to an F1 Visa so I can continue/finish up my schooling here. However, I have heard that I will have to pay out of state tuition when I switch to the F1, even though I have lived here for nearly 8 years straight. My parents obviously can't sign for an American loan because neither of them are American, and they won't be able to sign for a Canadian loan either because they will be going back to nothing/jobless. I really don't know what to do, and this might be a better question for the F1 forum. I just really don't think it's fair that I'm about to be in my last year of undergrad, and won't be able to finish because of this.

    Any help or advice would be greatly appreciated, thank you.

    Sorry to hear about your situation. I have couple of suggestions: Talk to your school and tell them your situation and ask them if you could still claim in state tuition since you have been residing there for 8 years. If not, then find out if there are any assitanship positions or on-campus jobs that would qualify you for instate tuition. Good Luck!

      I don't think there is any advantage for canandian student in this country! And they are nothing more other than A INTERNATIONAL STUDENT!!

      When your parents TN visa are expired and you still want to continues your education, there are several ways:

      (1) Transfer your study to any college/university in Canada.

      (2) Transfer your legal status to F1: And then you are not only pay out states tuition rate, but A INTERNATIONAL STUDENT RARE which is more expensive than out of states rate. Specially, student loan will not been qualified for most of international student in this country! Or get a scholarship!

      (3) Do nothing and countinue out of status: If you out of status more than 6 months, THEN THE PUNISHEMENT IS 10 YEARS BAN OF ENTRY OF US.

        I agree with 678olive! Talk to your college; they may be able to find a way! The way that a Canadian is treating is different due to the fact he is a northern American; it should be some advantage that you may have! Good luck.
