    Hi all,

    Someone I went to college with here in the States has started up his own company and has said he would like to employ me or offer an internship. At the moment the design company just consists of himself and once I come on board, me.

    Im just wondering are there any regulations as regards the employer who offers you work? ie size of company, turnover, financial health of company, etc.

    Does the job offer have to be within your specific field of study? If it is a full offer of employment, can I actually apply for a green card EAD? Again, would the fact that it is a single self-employed individual who runs the company be a problem?

    Any help or information greatly appreciated

    For H1 or GC, the company will have to prove that they have resources and business model to be able to pay you properly in accordance with labor laws. For GC they have to prove that there are no willing and able US Citizens or LPR's to do the job.

      great, thanks for the reply. What if I was just offered an internship through OPT? What responsibilities is there on the employer to show financial health or size of the company? I realize for OPT that the internship has to be related to your field of study which shouldnt be a problem. Im just curious as to whether the employer is scrutinized a lot before it can be accepted and I could avail of the offer

        You can work on OPT if the work is in your field of study.
        For H1 or GC your employer should consult with an immigration attorney. You can check the information section of immihelp. http://www.immihelp.com/
