  • Going from F1 to H1 with a foreign criminal record

    Hi,

I graduated from college in May and am currently on OPT. My employer would like to sponsor me for H1b, but I had a question..

In between my junior and senior year, I was convicted of assault in Singapore. I had to do some community service, and ultimately the conviction was expunged. My question is when I go from F1 to H1 status, will I have to declare anywhere that I was convicted of a crime in a foreign country? I was never out of status before, so I didnt have to declare it as an F1 student.

Secondly, considering the crime is the equivalent of a misdemeanor, if I do have to declare it, what will the chances be on my H1 being rejected?

    Thanks

Depends on the question, whether it asks for arrests, convictions etc.
This is my opinion and not legal advice.

Right, that is why I ask - does anyone know what questions they ask when going from F1 to H1?
