Hello All,
I did my diploma of 3 years after 10th (10 + 3 ) in 1999. Then started my Job immediately in India. In 2002 I did my +2 in Arts as a private candidate while in Job. I got a Job in US and Joined the company in June 2006 on H1B. I had applied for my GC with Employer A and I-140 was cleared.
I returned from US in September 2010 last year. I was working on H1 Visa with Employer A and my visa has expired in October 2011. Past One year I am in India and completed my BSc IT from Ellim Sikkim University through Distance Education. Results are awaited in December 2011.
I have a multiple 10 year business visa which mentions Employer “B” on the visa till 2015 on my Old passport which was damaged. I got a new passport issued. My old passport is cancelled but not the Visa. I carry both the passport together when I travel.
Now I have been offered a Job by Employer C in USA. I want to return to USA.
My question are:-
1) I have 12 years of Experience in IT. Suppose I want to do Masters of Science from a US University and get an I20. What are the chances that I will get the F1 Visa stamped in India.
2) Is it possible to change the status once I land in US on Business visa B1 to F1 based on the I-20 using a good Attorney.
3) Is it possible to change the status once I land in US on Business visa B1 to H1 based on the H1 petition (I-797) I may receive from Employer C using a good Attorney.
Please give me some tips or things I should be aware about. Share your experience if you have come across any such situation.
