My wife had her F1 visa interview this morning at the Mumbai Consulate and she was asked to submit a copy of my I-140 green card approval notice. My wife already has a valid H4 visa.
The question I have is that, my company does not provide the employees with the I-140 approval form. My I-140 is approved and I have the approval receipt number from the Immigration attorney but I do not have the I-140. If I cannot provide the I-140 document will her visa be considered rejected automatically?...and she can travel on her H4 visa. We already have our tickets booked for the first week of Jan ( less than 2 weeks).
If we do manage to get a copy of the I-140 approval from my company and submit it tomorrow, how long does the processing take to get the passport back?
I cannot decide if we should push to get the I-140 from my company and submit the document so that they can process it and give her a F1 visa, or tell them that we can provide the document and that will cancel her current F1 visa appliacation (correct?) and she can travel back to the US on her H4 visa.
