    Hi,
    My wife is on F1 visa and is a full-time student here. She has valid I-20 which will expire in 2013. Her F1 visa is expiring in May 2012. She went to India to renew it but the visa officer rejected the renewal because I gave my details as her financial caretaker and I have already filed for my GC and working on EAD. My EAD is valid till July 2013. My H1B has already expired. Is there some kind of visa my wife can get and stay in the US legally? She is in US right now.

    If her Visa was rejected how is she in the US right now?
    In any case, you will have to obtain H1 status and then she can apply for H4 Visa.

      It was only the F1 renewal which was denied not the F1 visa. She still has valid visa and I-20 thats how she came to US and got I-94 upon arrival.

        In that case she can live in the US as long as she maintains full-time student status (including OPT) with the sponsoring school. Ask the school's international advisor as to what she has to do to maintain status.
