Hi,
Im Currently working on extended OPT which is Valid thru NOV 2012.
My F-1 Visa stamping was for 3 years which got expired in SEP 2011.
My wife was having F-2 visa which got expired in SEP 2011 as well. But she went to India and she wants to come back but her F-2 visa is expired as mine but she got a new dependent i20 which is valid thru as my OPT validity(i.e. NOV 2012).
She went to embassy for her F-2 renewal but counsler denied her visa by saying that we can not renew your F-2 visa because primary Applicant's(F-1) visa is already expired. Even she showed them a valid approval of EAD/OPT card which is valid thru NOv 2012. But counsler said, we can't.
1. So my question is, F-2 visa renewal requires F-1 valid stamp? Is that the case my wife's F-2 rejected?
2. Can we re-apply F-2?
3. Or we shud apply for B1/B2 if their system does not allow F-2 until F-1 visa stamp is not valid?
4. Which wud be better to apply? F-2 again or B1/b2?
