I am from India and need help about a query.
I plan to apply for F-1 Student Visa if I get admitted to a graduate school this Fall'2012.
In May 2002, my mother's father filed a I-130 petition for my mother as a Married Daugher (She lives in India since birth and has never gone to the US, petition is pending).
This petition also listed me as a minor (I was 14 years old) and child of the principal applicant.
Today, I am 24 years of age, and hence was told no longer eligible for F-3 visa as I am over 21 years of age.
Can this pending I-130 on my mother's name as the principal applicant hurt my chances for an F-1 Student Visa ?
I have been working with a good pay in India over the past two and a half years and maintain bank accounts here.
Moreover, the petitioner himself is 77 years of age (being a U.S citizen) and lives in India since the past 8 years (has not visited U.S since then)
Please advise what could be documents that help prove I do not have an immigration intent. I have been living with my parents in India since birth.
I was also a sponsor for my mother's hospitalization in India last year and pay for her medical expenses, but the problem is the I-130 in her name for immigration.
Also, does being ineligible on the I-130 as I am over 21 years by age still mean that I have a pending I-130 in my name ? My name does not even appear on the Fee Collection page for the case, I think because I am over 21 now.
Please advise.
