My husband is on H1B. He got an admission in an university for his doctoral studies.

1. If he applies for his change of status from H1B to F1, how much time would it take for the processing of the petition?
2. Can he apply for a change of status from H1B to F1 and continue his job till his F1 gets approved?
3. If his change of status from H1B to F1 petition gets approved in June or July can he stay in US till he joins in August(Fall)?

Yes.
3. If his change of status from H1B to F1 petition gets approved in June or July can he stay in US till he joins in August(Fall)?
Yes, he needs to join the earliest semester after change of status gets approved.

My situation is little difference. My h1b visa will be expired in May, and I am going to go back college in Fall with F1 status. If I apply my change of status now, can I stay in US until Fall semester?If not, is that mean I have to start the school in summer?

Hi Meenakshi - I am in the same situation. I am applying for COS to F1 from H1 for PhD ; classes starting in Jan 2014. In case my COS is not approved by the time classes start, I know that I can start studying but can I also avail financial aid. Do you have any experience with this.

H1 B to F1 Visa Status change

Hello guys,

I am in a very similar situation as mentioned above.
My H1-B is valid till Dec 31 2015. And I am planning to go for Masters in the fall of 2015.
I have following queries:
1. If I change my H1-B status to Student. Considering that my I94 expires on 31 Dec 2015, Will I be allowed to change the status of my visa back to H1-b when I graduate in Aug 2017?
2. If yes, How long will my H1 be valid?

Need your help regarding change of status H1B to F1

I would like to apply for change of status I-539 to change from H1-B (expires 05/2016) to F-1 Visa (Got Spring Admission 01/2016), so that I can enroll in PhD program. But, my school recommended me to travel outside country and have the visa stamping, since they have other cases, and mentioned that USCIS has terrible log for 10months for change of status cases.

I would like to know your experience and advice regarding this. Are you experiencing same thing, I-539 cases are taking longer time? Please tell me what are the chances of F-1 visa will approve? I am afraid that even if I will wait for 10months, do you think chances are more for denial?
