Moved from F2 t H1B-

Hi

I have a question, i did a COS to F2 and my spouse was maintaining her F1 status. F2 got approved on Nov 30, 2011 and got a job with an employer A. Then New H1B was approved on Jan 4th but the notice date was on Jan 5th.

In how many days candidate should report to work. I have been informed that this being COS from F2 to H1B, candidate can have 30 days to report to work.

Candidate has never left USA in this period.

Dept. of Labor requires that the employer is responsible for paying after 30 days.

USCIS requires that the employee join immediately.
