  • F1 visa and H1 max limit

Hi I'm new to the site and this is my first query. Here's my situation. I have been in the US for the last 5.5 years (L1B Visa for the first 5 years, then converted to L1A visa this year). I'm planning to pursue my MBA in the US next year. If I get an admit, I will be joining college by fall of 2013.

By that time, I would have obviously completed the 6 year limit that is imposed on H1 visas. My question is, if I graduate after my MBA (COS to F1 from L1A), will I be employable in the US? Will I be eligible for a H1 visa anymore?

I'm not sure of how the OPT status works and if and how long I will be allowed to work on the OPT status after graduation.

Any help is extremely appreciated. I'm delaying my MBA application submission process for this very reason. Is there any way out of this?

P.S: My current employer will not file for a GC.

OPT is for 12 month, with an MBA you are not eligible for the 17 month STEM extension.

You may work provided you get OPT. In order to get H1B COS, you need a pending GC as you will be extending beyond 6 years, check with your H1B Employer (if any)
