I have an approved I140 from previous employment under H1. I have since left this employer and been out of US for over a year. I have offer with new employer in the US. They want me to start before I could get new H1 on October 1. This is not with the employer holding I140 and my priority date is likely years off. Will I have any trouble getting a TN in this instance?
