My family and I need help. My daughter and myself left the country to apply again for my tn visa. Have been doing the same thing since 2001 never have had a problem. During Katrina I lost my documents and went to the tent in our town where fema mema and border patrol was located. I explained that I had lost my documents and was given an extension and was assured that it would be entered into the computer not to worry. As soon as I got my documents, this year! we left the country. Upon entering the usa we were detained and told they had no information on me whatsoever. I was married to an american in 2004 and they held my daughter and myself for 6 hours and kept telling us everything was fine. they repeatly questioned us never telling us there was a problem. Then they stated they felt we over stayed my visa and referred our case to an immigration judge.
They also stated that the burden of proof was on us. How does one begin to start to uncover the government's lack of documentation? any suggestions?
