I have been in the US before on H1B and moved to Canada in 2019. Now I have got my Canadian citizenship. I have found an opportunity with a US employer who want to place me as a contractor at their end client office in NJ. I have a Canadian Incorporation registered. I have few questions on feasibility and workable scenarios that I want to clear before I can make decision:. Any help or past experiences in this kind of situation will be greatly appreciated.
1. Firstly can I work as an independent 1099 contractor in US and get TN visa based on it?
2. Do I have to involve my Canadian Corporation in the contract (e.g. does my US vendor has to sign a contract with my Canadian corp)? If so, who will write my TN letter, my Canadian corp or US vendor?
3. OR can I directly sign 1099 contract with US vendor as an individual and still get TN visa without involving my Canadian corp?
4. Is 1099 too complicated and working simply as W2 is better and safe? W2 has rate disadvantages so wanted to avoid it.
I really need to make a decision soon and I desperately want to re-enter US and have an opportunity in hand right now. Please advise.
